These Terms of Service ("Terms") govern your use of the Eat & Perform mobile
app ("the app", "we", "us"). By creating an account or using the app, you agree to
these Terms. If you don't agree, don't use the app.
1. Who we are
Eat & Perform is operated by Eat & Perform Ltd, a company registered in England and
Wales (company no. 17527955), registered office 53 Hey Street, Long Eaton,
Nottingham, NG10 3HA ("the Company").
Contact: info@eatandperform.com.
2. Eligibility
You must be at least 16 to create an account, and at least 18 (or have a
parent/guardian's consent) to purchase a subscription, since a subscription is a
binding financial contract. If you're between 16 and 18, a parent/guardian must
handle any purchase on your behalf via their own App Store/Play Store account.
3. Not medical or professional advice
Read this section carefully.
Eat & Perform calculates estimated calorie and macronutrient targets from
data you provide and data read from connected wearables/training platforms. These
are estimates based on general sports-nutrition formulas, not a
medical, dietetic, or clinical assessment of you personally.
The app is not a substitute for advice from a doctor, registered
dietitian, or other qualified healthcare professional.
If you have a medical condition, are pregnant or breastfeeding, have a history
of disordered eating, or are under medical supervision regarding diet, nutrition,
or training load, consult a qualified professional before changing your
diet or training based on anything in the app.
Allergy filtering is a best-effort safety feature, not a
guarantee. Recipe and product data (including data from third parties
such as Pepesto and supermarket product listings) may be incomplete, outdated, or
incorrect. You are responsible for independently checking ingredient labels and
verifying any product is safe for your specific allergies or intolerances before
consuming it. Never rely on the app as your only safety check for a food
allergy.
Training load, zone, and recovery calculations are derived from third-party
wearable/platform data (Apple Health, Strava, and others as they're added) which
we do not control and cannot guarantee is accurate.
4. Subscriptions, billing, and the basket-send fee
The Eat & Perform subscription is auto-renewing, billed through the Apple App
Store or Google Play Store, on whichever platform you subscribed. We do
not process subscription payments or store card details ourselves.
Any free trial converts automatically to a paid subscription at the end of the
trial period unless you cancel before it ends.
Cancel anytime via your Apple ID or Google account
subscription settings — cancelling in-app removes local preferences only and
does not cancel the billing subscription; you must cancel through the store you
subscribed via.
Refunds for the subscription are handled by Apple or Google
under their own policies, not by us directly — we have no ability to issue a
refund on your behalf.
We may change subscription pricing for future billing periods with reasonable
advance notice; continuing to use the app after a price change takes effect means
you accept the new price.
Sending a shopping list to your supermarket basket carries a separate,
one-off fee (shown in the app before you confirm), charged via Stripe at
the moment you send the list — this is independent of your subscription and
billed separately. Checkout and payment for the groceries themselves happens on
your supermarket's own site and is entirely outside our control.
5. Filling your supermarket basket
The basket service uses your own account with the supermarket you choose. You sign
in on the supermarket's own website inside the app. We do not receive or store
your supermarket password.
Our technology partner, Pepesto, adds the items you confirmed to your supermarket
basket on your behalf. While it does, it reads the supermarket's pages and takes
screenshots of them, which may include personal details shown on those pages, such as
your name and delivery address. Our Privacy Policy explains how this is handled.
This service is provided by Eat & Perform and its technology partner, not by the
supermarket. The supermarket's own terms apply to your account, and a supermarket may
ask you to sign in again or take action on an account used with automated services.
You choose whether to use the basket service with your account.
We do not sell the groceries. Your order, prices, substitutions, delivery, charges
(including any small-basket or delivery charge) and refunds for the groceries are
between you and the supermarket. Prices we show before sending are estimates.
The basket fee pays for filling your basket. If filling stops partway, sending again
continues the same basket at no extra charge.
Nothing is ordered until you book a slot and pay on the supermarket's site.
Nothing in these terms limits your rights under UK consumer law.
6. Third-party integrations
The app connects to third-party services (Apple Health / Health Connect, Strava,
WHOOP and TrainingPeaks when available, and Pepesto for recipes and grocery
matching/checkout). Your use of each is also subject to that provider's own terms. We
are not responsible for the availability, accuracy, or content of any third-party
service, or for the actual checkout/delivery process on a supermarket's own website,
which is entirely outside our control.
7. Your responsibilities
You agree to provide accurate information (especially allergies, medical
conditions relevant to nutrition, and body metrics used in calculations), to use the
app only for its intended personal, non-commercial purpose, and not to attempt to
reverse-engineer, resell, or misuse the service.
8. Intellectual property
The Eat & Perform name, logo, app design, and underlying software are owned by
the Company or its licensors. Using the app doesn't grant you any ownership or
licence beyond personal use of the app itself.
9. Disclaimer of warranties
The app is provided "as is" and "as available." To the fullest
extent permitted by law, we disclaim all warranties, express or implied, including
that the app will be uninterrupted, error-free, or that any calculated target,
recommendation, or matched product will be accurate or suitable for your specific
circumstances.
10. Limitation of liability
To the fullest extent permitted by law, the Company's total liability to you for
any claim arising from your use of the app is limited to the amount you paid us in
the 12 months before the claim arose, and we are not liable for indirect, incidental,
or consequential losses. Nothing in these Terms limits liability for death or
personal injury caused by our negligence, for fraud, or for anything else that cannot
lawfully be limited or excluded.
11. Termination
You may stop using the app and delete your account at any time (Settings →
Account → Delete account). We may suspend or terminate your account if you
breach these Terms, including providing knowingly false safety-relevant information
(e.g. allergies) or misusing the service.
12. Changes to these Terms
We'll notify you in-app of material changes before they take effect. Continuing to
use the app afterwards means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and any dispute is
subject to the exclusive jurisdiction of the courts of England and Wales.
